Will of Alice Pickford spinster of Ashton under Lyne 1753 (aunt of Grace Catlow nee Pickford)

 

In the Name of God Amen I Alice Pickford of Ashton

Underline in the County of Lancaster Spinster Do make and publish this my last Will

and Testament in manner following (to witt) I Give and Devise unto George Lloyde of

Hulme in the County of Lancaster and John Bradshaw of Manchester in the said County

Esquires their Heirs and Assigns All these my four Closes Fields parcells of land

and the now erected Buildings Improvements thereupon lately made with their

Appurtenances Scituate lying and being in Green Acres in the parish of Oldham boath in

the said County Or One of them late or heretofore in the several holdings or Occupations of

Daniel Whitehead and Amos Ogden or One of them Subject to the payment of a Yearly

Rent of Twenty Shillings by me heretofore Given and Granted and made payable to the

Rector of the Parish Church of Ashton Underline and the Church Wardens thereof for the time

being According to a certain Deed bearing date the Fourteenth day of June in the Year

of our Lord one thousand Seven Hundred and Forty And also all that my Messuage and

Tenement with the Barn other Buildings thereunto belonging and the parcels of land

called the Orchard and Garden with the Appurtenances Scituate lying and being in Thornlee

in the parish of Saddleworth and County of York And also all that Close field parcel of

land with the Appurtenances called Calf Hey Meadow to the said Messuage or Tenement

last above mentioned belonging or therewith Usually enjoyed lying and being in Thornlee

and parish of Ashton Underline aforesaid One of them And all these my other Closes or fields

to and with the same Messuage and Tenement belonging or therewith Usually Occupyed and

Enjoyed lying and being in the parish of Ashton Underline aforesaid and comonly called and

known by the Several Names of the New field, the Beut, the Great Pingott, the little Pingott

the Beut Brow, and the little Beut now or late in the Severall tenures or Occupations of

John Hawkyard Robert Hawkyard and William Hawkyard Some or One of them then

or Some of their Assignee or Assigns To have and to hold all and every the said

Hereditament and premisses with the Appurtenances unto the said George Lloyde and John

Bradshaw and the Survivor of them his Executors Administrators Assigns do and

shall from time to time during the lifetime of my said Neice Elizabeth Palin whether

Rents, Issues and Profits of all the said premisses to the proper hands of my said Niece

Palin for and during so long of the said Term of Ninety Nine Years as she my said Niece

shall happen to live to and for her Sole and Separate life and benefit free from the

Controul or Disposal of her present or any subsequent Husband She shall happen to be

Married to And I will and Order that my said Niece's Receipts notwithstanding her Coverture

shall be good and Effectual Receipts and Discharges to the said Trustees or either of them

for So much Money as they or either of them shall so pay to my said Niece. And as for and

Concerning All the said Messuage Lands Hereditaments and promisses given in Trust

for the said Term of Ninety Nine Years Determinable aforesaid from and after my said

Nieces death I Give and Devise the same premisses unto the said George Lloyde and John

Bradshaw their Heirs and Assigns Upon Trust and Confidence Nevertheless and to the Use

and behoof of all and every the Child (if only one Child) or Children (if more than one Child) of the

Body of my said Niece Elizabeth Palin already begotten or to be begotten and born and his her

 

and their Several and Respective Heirs and Assigns forever Such said Children and their Respective

Heirs and Assigns (if more than One such Child) to take hold and Enjoy the same as Tenants in Comon

and not as Joynt Tenants Equally to be divided amongst them Share and Share alike And if my

said Niece Elizabeth Palin shall dye and depart this Natural life without any Issue of her body

then liveing if She leave such Issue at the time of her Decease and all Such Issue dye before any

of them Shall Attain the Age of Twenty One Years Then and in Such Case after my said Nieces

death without Issue as aforesaid Or on all such Issue dying before any of them Attain the Age of

Twenty One Years as the Case shall happen to be I give Devise and Dispose of All the above

Mentioned Messuage other Buildings lands Hereditaments and premisses above mentioned

and every part and parcel thereof with their and every of their Appurtenances unto and to

the Use of the said George Lloyde and John Bradshaw their Heirs and Assigns upon  Trust and

Confidence Nevertheless and to the Intent and purpose that they the said George Lloyde and John

Bradshaw and the Survivor of them and his Heirs do and Shall with all Convenient speed after

such Contongency shall happen as aforesaid Absolutely sell and dispose of the Fee Simple and

Inheritance of all the above mentioned Hereditaments and premisses and the money to be Raised by such

Money that can be Really had and gotten for the same premisses and the money to be Raised by such

Sale as aforesaid and the Rents Issues and profits of the said Hereditaments and premisses after my

said Nieces death without Issue as aforesaid Untill such Sale or Sales shall be made as aforesaid

(after deducting thereout by the said Trustees or Trustee all Costs Charges and Expences he they or any of

them shall Sustain or be putt unto on Account of the said Trust or anything relateing or belonging

thereto which I hereby Authorize and Impower them and every of them to do) I will and order to be

divided into Three Equall Shares or parts One Third whereof I Give and Bequeath unto the Two

Sons of my late Nephew Joseph Pickford Esquire (Deceased) Equally to be divided between them Share

and Share alike. One other Third part thereof I give and bequeath unto All the Children of the late

William Gibbon deceased Equally to be divided amonst them Share and Share alike And the other

Third part thereof I Give and Bequeath unto all the Children of the late Jonathan Cattlow deceased

Equally to be divided amongst them Share and Share alike Also I give and bequeath out of

my personal Estate unto James Cattlow Son of the late Jonathan Cattlow the Sum of Fifty

Pounds Sterling to be paid him without Interest at his Age of Twenty One Years Also I give

and Bequeath pout of my Personal Estate unto Joseph Cattlow and Grace Cattlow another Son and

Daughter of the late Jonathan Cattlow each of them the Sume of Seventy Pounds Sterling to be paid

them Respectively during their Respective Infancies for their Several Maintenance s and

Educations at the time of their Respective Ages of Twenty One Years and in Such manner and

proportions as my Executors hereafter mentioned shall think proper Also I Give and Bequeath

unto the said James Cattlow his Executors Administrators and Assigns the Moiety or half part

of All that my Messuage and Tenement with the Appurtenances Scituate lying and being in

Ashton Underline aforesaid and Comonly called and known by the Name of the Orchard and All my

Estate and Interest in the same Moiety Also I give and Bequeath unto Samuel Gibbon son

of my niece Cattalina Wood by her former husband William Gibbon Deceased his Executors

Administrators and Assigns the Other Moiety or half part of the said last mentioned Messuage

and Tenement with the Appurtenances in Ashton Underline aforesaid comonly called the Orchard

and all my Estate and Interest in the Same Moiety Also I Give and Bequeath out of my personal

Estate unto the said James Gibbon and unto Elizbeth Gibbon and unto Cattalina Wife of Miles

Greaves of Ashton Underline aforesaid Apothecary the Sume of One Hundred Pounds Sterling

each at the End of Twelve Months next after my Decease Also I give and bequeath out of my

Personal Estate unto and Equally to be divided between and amongst James Cattlow Joseph

Cattlow and Grace Cattlow (Sons and daughter of the said Jonathan Cattlow) Unto Alice wife of

John Cock of Ashton Underline aforesaid Chapman and unto Priscilla Eyre wife of Joseph Eyre

of Dedham in the County of Essex Esquuire the Sume of Four Hundred Pounds Sterling Share and

Share alikeTo be paid to such of them as shall be Twenty One Years of Age at my Death in Twelve

 

Months afterwards And to Such of them as shall be Under the Age of Twenty One Years (if

any at my Decease) At their Respective Attainment to the Age of Twenty One Years Also I

Give and Bequeath out of my said personal Estate unto the Person or Persons who shall Act for the

Children of my late Nephew Joseph Pickford Deceased the Sume of Fifty Pound Sterling for and

towards discharging A Note given by my said Nephew to the late Samuel Newton of Ashton Underline

(Deceased) Upon Account of Samuel Crabtree of Ashton Underline aforesaid Mason Also I give and

Bequeath out of my personal Estate unto Grace the wife of the said Samuel Crabtree the Sume of Fifty

Pounds Sterling to be paid her at Twelve Months End next after my Decease Also I give and

Bequeath unto my Niece Cattalina Wood the Sume of Ten Pounds to buy her Mourning with?

Also I Give and Bequeath unto such person as shall live with Me as my Maid Servant at the

time of my Death the Sume of Ten Pounds Sterling and Five Pounds more to Buy her Mourning

Also I Give and Bequeath unto my Niece Elizabeth Palin the Sume of Two Hundred Pounds

Sterling to be paid her at Twelve Months end next after my Decease out of my Personal Estate

Also I Give Devise and Bequeath unto Grace Cattlow Daughter of the late Jonathan Cattlow

my Part or Share of the Pew belonging to Me in Ashton Church wherein I Usually Satt Also I

Give Devise and Bequeath unto Joseph Pickford Son of the late Joseph Pickford that

Front Pew upon the Gallery in Ashton Church which my late Nephew Joseph Pickford and family

Used to Sitt in And a little Seat or Pew upon the said Gallery belonging to me Provided my said Cosin

Joseph Pickford Revoke any Claim or Right he has or can Claim to the Seater Pew by Ne heretofore

given to the said Grace Cattlow Which if he Shoud Refuse My Will and Mind is that the said Grace

Cattlow have one half of the Great Pew given to the said Joseph Pickford aforesaid anything

herein before contained to the Contrary notwithstanding Also my Will and Mind is that All my

Wearing Apparrel shall After my Decease be Equally divided into Three Parts or Shares One

third part Whereof I give and Bequeath unto the said Elizabeth Palin One other Third Part

thereof I give and bequeath unto Cattalina Wood And the last Third part thereof  I give

and Bequeath unto Grace Cattlow daughter of the late Jonathan Cattlow Also I give and

Bequeath unto my Executors hereafter mentioned the Sume of Fifty Pounds Sterling Each

Also I Give and Bequeath unto Jonathan Lay of Ashton Underline aforesaid Chapman

the Sume of Twenty Five Pounds Sterling And my Will and Mind is that the said Jonathan

Leay be an Assistant to my Executors hereafter mentioned he knowing my affairs best

And all the Rest residue and Remainder of my personal Estate my Will and Mind is shall

be Equally Divided into Three parts or Shares One Third part whereof I give and Bequeath

unto my late Nephew Joseph Pickford Two Sons Share and Share alike; One other Third

part thereof I give an dbequeath unto the Children of the said Cattalina Woods to be

Equally divided amongst them Share and Share alike And the other Third or last part

thereof I Give and Bequeath unto the Children of the late Jonathan Cattlow Dec[eas]ed

Equally to be Divided amongst them Share and Share alike Provided allways

and my Will and Mind is that the Children of the late Jonathan Cattlow shall not receive or

Respectively Release and Discharge the said Miles Greaves of and from all Claims and

demands which they have or can claim Respectively against him or any other person

for or on Account to the said Miles Greaves Selling and Disposeing of a Messuage and

Tenement called Cockhill Pump Tenement or anything Relateing thereto And I the

said Alice Pickford do herehy Revoke and make Void All former Will and Wills and

Testaments by Me made and Nominate Constitute and Appoint Edward Gregg of Chamber

Hall in the County of Lancaster Esquire and Robert Gartside of Manchester and County

aforesaid Chapman Executors of this My Last Will and Testament And Order and

 

Direct that they be allowed all Reasonable Charges they shall Expend on

Account of their said Executorship And also their Trouble in the Execution thereof

or anyways relateing thereto In Witness whereof I the said Alice

Pickford have hereunto Sett my Hand and Seal this Twenty Third day of May

in the Year of our Lord One thousand Seven Hundred and fifty Seven (1757)
